I think that's one of the reasons Elon bought Twitter. He owns both the dataset (Twitter's posts) and the model (Grok). And people have to opt in if they want to keep using Twitter.

This means that Musk might support the case against the non-consensual LLM training as it'd generate many problems for his competition (OpenAI et consortes) and show him in a good light.
