You think AI-generated art can’t be copyrighted? That’s the headline circulating everywhere today. It’s also a misleading interpretation of what actually happened. The US Supreme Court did not rule that AI art cannot have copyright. It simply declined to hear an appeal in a very specific case where a computer scientist tried to register a copyright with an AI listed as the sole author, with no human creator at all. Under US law, copyright has always required human authorship, so the lower court decision simply remained in place. That’s very different from saying AI-assisted works cannot be protected. | |
